2. Datos, finalidad y necesidad / Data, purpose and necessity
ES: Se tratan datos de contacto, reserva, pasajeros, facturación/pago confirmado, comunicaciones y consentimiento. Cada formulario marcará qué campos son obligatorios, la finalidad, consecuencias de no suministrarlos, destinatarios y derechos. No se solicitarán datos de salud en texto libre general; si son necesarios para seguridad, tendrán consentimiento separado y acceso limitado.
EN: Contact, booking, passenger, invoicing/payment-confirmation, communications and consent data are processed. Each form will identify required fields, purpose, consequences of not providing them, recipients and rights. Health data will not be requested in a general free-text field; when required for safety, separate consent and restricted access will apply.
3. Encargados y transferencias / Processors and transfers
ES: Para operar el servicio se usan proveedores con acceso limitado a los datos necesarios: Tours Tico Online (reservas), Supabase (infraestructura de base de datos), Resend (correo transaccional), Hostinger (alojamiento web), PayPal (pagos de Sea Saw), Banco LAFISE (enlace de pago de Pacific Dream), proveedores técnicos de WordPress/Jetpack cuando estén activos y la tripulación que necesita la información para ejecutar el tour. Algunas prestaciones pueden implicar tratamiento fuera de Costa Rica. WhatsApp/Meta aplica sus propias políticas cuando el usuario decide usar ese canal. Los datos también podrán comunicarse a autoridades cuando exista obligación legal.
EN: The service uses providers with access limited to the data they need: Tours Tico Online (bookings), Supabase (database infrastructure), Resend (transactional email), Hostinger (web hosting), PayPal (Sea Saw payments), Banco LAFISE (Pacific Dream payment link), WordPress/Jetpack technical providers when active, and crew members who need information to deliver the tour. Some services may involve processing outside Costa Rica. WhatsApp/Meta applies its own policies when the user chooses that channel. Data may also be disclosed to authorities where legally required.
4. Pagos / Payments
ES: Sea Saw y Tours Tico Online no deben almacenar el número completo de tarjeta ni el CVV. PayPal procesa los datos de pago bajo sus propios controles; Sea Saw recibe la referencia, importe y estado necesarios. Para Pacific Dream, Banco LAFISE gestiona el enlace externo de pago. Nunca se solicitarán datos completos de tarjeta por correo, formulario general o WhatsApp.
EN: Sea Saw and Tours Tico Online must not store full card numbers or CVV. PayPal processes payment data under its own controls; Sea Saw receives the necessary payment reference, amount and status. For Pacific Dream, Banco LAFISE manages the external payment link. Full card details will never be requested by email, general contact form or WhatsApp.
5. Cookies, almacenamiento y medición / Cookies, storage and measurement
ES: El sitio utiliza almacenamiento técnico y registros necesarios para seguridad, funcionamiento y conservación de preferencias. Puede utilizar medición proporcionada por Jetpack, Site Kit u otros proveedores cuando estén activos. Cuando la normativa exija consentimiento, las etiquetas opcionales de analítica o publicidad solo se cargarán después de otorgarlo. La información sobre cookies se mantendrá conforme al inventario técnico real.
EN: The site uses technical storage and logs necessary for security, operation and preference storage. It may use measurement provided by Jetpack, Site Kit or other providers when active. Where consent is legally required, optional analytics or advertising tags will load only after consent is given. Cookie information will be maintained from the actual technical inventory.
6. Conservación / Retention
ES: Las consultas que no terminan en reserva se conservarán hasta doce meses. Las reservas, pagos y comprobantes necesarios para obligaciones contables, tributarias o defensa de reclamaciones se conservarán cinco años, salvo que una norma o litigio exija más. Los datos de salud obtenidos excepcionalmente para seguridad se eliminarán treinta días después del tour, salvo incidente o reclamación. La autorización de imagen se conservará mientras se use el material y hasta que se retire, con revisión máxima cada tres años.
EN: Enquiries that do not become bookings will be retained for up to twelve months. Booking, payment and receipt records needed for accounting, tax or legal-claim purposes will be retained for five years unless law or litigation requires longer. Health information exceptionally obtained for safety will be deleted thirty days after the tour unless an incident or claim requires retention. Image consent will be retained while the material is used and until withdrawn, with review at least every three years.
7. Derechos / Rights
ES: La persona puede solicitar acceso, rectificación, supresión cuando corresponda y revocar consentimiento, sin efecto retroactivo sobre tratamientos ya lícitos. Se verificará identidad de forma proporcional, se registrará la solicitud y se responderá en el plazo legal. También puede acudir a PRODHAB.
EN: Individuals may request access, correction, deletion where applicable and withdrawal of consent, without retroactively affecting lawful processing. Identity will be verified proportionately, requests logged and answered within the statutory period. Complaints may also be submitted to PRODHAB.
8. Fotos, video y menores / Photos, video and minors
ES: La autorización de imagen para marketing será separada y opcional. Para menores identificables se obtendrá consentimiento expreso del responsable legal antes de cualquier publicación, con registro del activo, canales, finalidad y retiro. Negarse no afecta el servicio.
EN: Marketing image consent will be separate and optional. For identifiable minors, express consent from the legal guardian will be obtained before publication, recording the asset, channels, purpose and withdrawal. Refusal does not affect the service.
9. Seguridad e incidentes / Security and incidents
ES: Se aplicarán controles de acceso limitado por función, mínimo privilegio, cifrado en tránsito, respaldo, registro y respuesta a incidentes conforme a los servicios realmente configurados. No se promete seguridad absoluta. Los datos sensibles no deben enviarse por el formulario general.
EN: Role-limited access, least privilege, encryption in transit, backups, logging and incident response will be applied according to the services actually configured. Absolute security is not promised. Sensitive information must not be sent through the general contact form.
